Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Select Service Pros website at selectservicepros.com and any related services (collectively, the "Services"), which are operated by Select Service Pros LLC, a Texas limited liability company ("SSP," "we," "us"). These Terms apply to you if you use the Services as a homeowner or other person seeking home-service work. Contractors who sign up to receive leads through SSP are subject to a separate Contractor Service Agreement, not these Terms.

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Nature of the Services

SSP operates an online marketplace that connects homeowners looking for home-service work with independent licensed contractors who bid on that work. SSP is not a contractor, home-service provider, or agent for either the homeowner or the contractor. SSP does not perform, supervise, warrant, or stand behind any service performed by a contractor, and SSP is not a party to any agreement or transaction between a homeowner and a contractor.

Please read this carefully: When you retain a contractor introduced to you through SSP, you are entering into an agreement directly with that contractor for the work they perform. SSP's role ends at the introduction. Any disputes about workmanship, price, warranty, timing, or conduct are between you and the contractor.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services, you represent that you meet these requirements. The Services are directed to users in the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local law.

3. Accounts and account security

You do not need to create an account to submit a homeowner service request. If you do create an account, you agree to provide accurate, current, and complete information, to keep your login credentials confidential, and to notify us promptly of any unauthorized access. You are responsible for all activity that occurs under your account.

When you submit a homeowner service request through the Services, you agree that:

5. Third-party contractors

Contractors who participate in the Services are independent businesses, not employees or agents of SSP. Although SSP requires contractors to represent that they are licensed and insured (where applicable) and to enter into a Contractor Service Agreement, SSP does not independently guarantee any contractor's licensing status, insurance, workmanship, pricing, warranties, business practices, or conduct. You are solely responsible for verifying a contractor's credentials, obtaining and reviewing quotes, and deciding whether to hire.

SSP may perform license or credential checks against public state licensing databases and may display verification badges when a contractor's information has been verified. Such badges reflect only that we performed a check at a particular point in time and are not a warranty. Licensing and insurance status can change; you should confirm current status directly with the contractor and with the relevant licensing authority before hiring for significant work.

6. Communications from SSP and contractors

By using the Services and providing your contact information, you consent to receive communications from SSP and from matched contractors relating to your service request, including by phone, text (SMS), and email, using the information you provided.

Detailed information about how we handle SMS messaging — including opt-in, opt-out (reply STOP), help (reply HELP), message frequency, message and data rates, and audit records of your consent — is set out in Section 5 ("SMS / text messaging") of our Privacy Policy, which is incorporated into these Terms by reference. Consent to receive SMS is not a condition of using the Services.

7. Fees

The Services are free for homeowners. You do not pay SSP to submit a service request, receive matches, or receive quotes. Fees you agree to pay a contractor for work performed are payable to the contractor directly, on terms you and the contractor agree.

When you use the Services, you agree not to:

We may suspend or terminate your access to the Services if we determine, in our reasonable judgment, that you have violated these Terms or acted in a way that harms other users, contractors, or SSP.

9. User content

You retain ownership of any content you submit through the Services (e.g., descriptions of your job, photos, reviews). By submitting content, you grant SSP a non-exclusive, worldwide, royalty-free license to use, display, distribute, and process that content for the purposes of operating and improving the Services, including routing your request to contractors and displaying reviews where applicable. You represent that you have all necessary rights to submit any content you provide.

10. Intellectual property

The Services, including all text, graphics, logos, software, and design elements, are owned by SSP or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the Services.

"Select Service Pros," the SSP logo, and other SSP marks are trademarks of SSP. You may not use them without SSP's prior written permission.

11. Termination

You may stop using the Services at any time. If you have an account, you may request deletion by emailing support@selectservicepros.com. See Section 9 of the Privacy Policy for data retention details after termination.

We may terminate or suspend your access to the Services at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users or to SSP.

12. Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SSP disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.

Without limiting the foregoing, SSP does not warrant that the Services will be uninterrupted, secure, error-free, or that any defects will be corrected. SSP does not warrant the quality, safety, legality, or fitness of any contractor's work.

13. Limitation of liability

To the maximum extent permitted by law, in no event will SSP be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, loss of goodwill, business interruption, or personal injury, arising out of or related to your use of the Services or your dealings with any contractor introduced through the Services, whether based on contract, tort, strict liability, or any other legal theory, even if SSP has been advised of the possibility of such damages.

SSP's total aggregate liability to you for all claims arising out of or relating to the Services will not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the above exclusions and limitations apply only to the extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless SSP and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your interactions or agreements with any contractor introduced through the Services, (c) any content you submit, or (d) your breach of these Terms.

[Legal review required — SSP may prefer to add a mandatory arbitration clause with class-action waiver here. As of the effective date of these Terms, SSP has not made a final decision on binding arbitration. Until then, the default is court jurisdiction as set out in Section 16.]

Before filing a claim against SSP, you agree to try to resolve the dispute informally by contacting legal@selectservicepros.com. If we cannot resolve the dispute within 60 days, either party may proceed as set out in Section 16.

16. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 15, any action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Harris County, Texas, and both parties consent to the personal jurisdiction of those courts.

17. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify users by email (to the address on file), by SMS (if you've opted in), or by prominent notice on the Services before the changes take effect. The "Effective date" at the top of these Terms indicates when they were last updated. Continued use of the Services after the effective date of a change constitutes acceptance of the updated Terms.
